As required by development needs and practical demands of domestic and foreign investors, the Government has issued Decree No.35/2022/ND-CP with many new amendments and supplements that they are more progressive than Decree No.82/2018/ND-CP on management of industrial parks and economic zones. In particular, the addition of new models in industrial parks and economics zones is considered as a new point of interest in Decree 35.
1. OVERVIEW
Currently, the development model of industrial parks and economic zones in the world has changed significantly in the direction of professional, specialization and solid development, ensuring modernity, competitiveness and catching up with the process of the industrial revolution 4.0. In Vietnam, industrial parks are still mainly developing in the direction of multi-sector, multi-field. Although, in recent years, some types of clean industrial parks (ecological industrial parks), specialized industrial parks, and supporting industrial parks have been established in some provinces, but the number is still limited, faced with many difficulties due to synchronous the infrastructures have not been invested synchronously, no residential areas and necessary facilities for experts and workers. In addition, the current coastal economic zones all share the same investment orientation of multi-sectoral development and unclear defined sectors.
With the goal of developing new advanced industrial park models, in line with the developing trend in the world, increase the connection and support between enterprises in the region and between regions on a national scale, the Government has directed in Resolution No. 50/NQ-CP dated May 20, 2021 and specifically provided in Decree 35 to improve operational efficiency and promote new types of industrial parks.
2. CONTENT
As provided by Decree 35, there are 02 new models of industrial parks and 02 new models of economic zones, specifically as follows:
Specialized industrial park (Article 2.4, Decree 35): A type of industrial park specializing in the production and provision of services for the production of products of a certain industry, such as: textiles, footwear, automobiles, electronics, etc. In a specialized industrial park, at least 60% of the industrial land area of the industrial park must be used to attract investment projects in the mentioned above industry. Specialized industrial parks are encouraged, enjoying many advantages, incentives in terms of procedures, land rent exemption and reduction, priority for credit loans, tax incentives, etc. (Article 32, Decree 35).
The supplement is for the purpose of forming a close link in production and promote business cooperation between enterprises in the same industry. Therefore, there will be linked between businesses to help optimize production lines, to improve competitiveness and join the global value-added chain of Vietnamese industries.
High-tech industrial park (Article 2.6, Decree 35): A type of industrial park that attracts investment projects in science and technology, high technology, technology transfer, environmental protection, and start-up, creativity, innovation, research and development, education and training, technology incubators, science and technology business incubators. In a high-tech industrial park, at least 30% of the industrial land area of the industrial park must be used to attract the above-mentioned investment projects. High-tech industrial parks are encouraged, enjoying many advantages, incentives in terms of procedures, land rent exemption and reduction, priority for credit loans, tax incentives, etc. (Article 32, Decree 35).
The supplement is for the purpose of improving the current level and technological capacity, advanced production capacity of enterprises in the industrial park today. Thereby, helping localities have a solid foundation in science, creating new production tools based on science and technology, meeting well the requirements of production and business in the current 4.0 era.
Special economic zone (Article 2.16, Article 5.4, Decree 35): A type of economic zone established in a main point economic zone, with an area of 5,000 hectares or more, capable of favorable connection with other economic zones, regional and international economic corridors, easy access to international markets.
The supplement is for the purpose of providing the provinces and centrally-run cities in the key economic region the opportunities to develop and promote the advantages of favorable international market connection conditions, quality human resources, etc. high quality in the region to create high-quality human resources to attract and develop internationally competitive industries and fields.
Non-tariff zone within an economic zone (Article 2.17, Article 30, Decree 35): An area with geographical boundaries defined in the general planning for construction of an economic zone, separated from the outside by rows of rows. hard barriers, ensuring conditions for customs inspection, supervision and control by customs authorities and relevant agencies for import and export goods and means of transport, issues related to related to export and import (including inspection, supervision, control activities of customs, ...).
Non-tariff zones in economic zones carry out trade, investment, production, business and service activities such as temporary import for re-export or temporary export, re-import, transit, border-gate transshipment and transshipment of goods. chemical; providing services related to export and import activities; trading in tax-free goods, tax-free goods and discounts; logistic services; manufacturing, processing, recycling, assembling, classifying and packing goods for export and import and providing related services and other goods and service business activities as prescribed by law.
3. CONCLUSION
The addition of these new models of industrial parks and economic zones increases the attractiveness of investment in industrial parks and economic zones, thereby completing a number of types of industrial parks and economic zones that in Decree No. 82/2016/ND-CP has not yet been clearly defined.
