Principle 1: The duties, rights, obligations, roles, and responsibilities of the Contracting Parties must be clearly defined in the General Conditions of Contract (GCC) and must align with the project’s requirements.
Principle 2: The Particular Conditions of Contract (PCC) must be drafted with clarity.
Principle 3: The PCC must not alter the risk-benefit allocation balance as stipulated in the GCC.
Principle 4: All timeframes for the obligations of the Contracting Parties, as specified in the contract, must be reasonable.
Principle 5: Unless in conflict with the governing law of the contract, all disputes must be resolved by the Dispute Adjudication Board/Dispute Avoidance and Adjudication Board (DAB/DAAB) through a decision, which is a prerequisite before arbitration.
