LEGAL UPDATE

On April 28, 2023, the Government promulgates Decree No. 18/2023/ND-CP amending and supplementing a number of articles of Decree No. 40/2018/ND-CP dated March 12, 2018 providing regulatory framework for multi-level marketing (“Decree 18”). Accordingly, Decree 18 has amended and supplemented some of the following outstanding new points:

1. Experience in multi-level marketing of foreign investors, foreign-invested economic organizations that are owners or members or shareholders of a company registering for multi-level marketing activities in Vietnam.

2. Supplementing the required documents Application for the Multi-level Marketing Registration Certificate

3. Regarding the submission of dossiers

4. Registration of Multi-level Marketing in a province

5. MLM conferences, meetings and training programs

6. Obligations of MLM company and MLM participant

7. Effect of Decree 18.
