CLIENT:
A Vietnam-based subsidiary of a New Zealand diary-related product producer
BACKGROUNDS:
Client is a New Zealand-owned company whose parent company is a leading global corporation and one of the world’s largest exporters of dairy-related products with well-known dairy brands in Asia and the rest of the world. In Vietnam, the Client is currently specializing in importing and distributing milk and dairy products aimed at all ages.
Since 2012, Client has appointed ATIM LAW FIRM to provide legal advice for the purpose of keeping their import, circulation and distribution of dairy products in Vietnam market compliant with the applicable laws.
CHALLENGES AND SOLUTIONS:
It is worth noting that most of dairy products distributed are in the FMCG category, which may affect directly human health. Currently, Vietnamese applicable laws have provided stringent regulations and requirements concerning the FMCG product distribution, including but not limited to restrictions and conditions on announcement, testing, labelling, experimental, etc. It is perhaps that this is one of the tremendous challenges for foreign investors to enter the Vietnam market to fully comply with the current regulations
From our viewpoint, both the applicable laws and practical requirements of Vietnam on product registration as well as product-related sectors such as advertising, promotion, marketing or events involved relatively complex procedures for registration or application. ATIM LAW FIRM, thus, always used all its best endeavors to assist the Client in completing any relevant procedures to legally import and distribute the dairy products into the Vietnamese market.

In ATIM’s attempt to support the Client and with Client’s great coordination, business contract templates were eventually completed after several rounds of review. Also, required procedures as mentioned above with the competent authorities were conducted relatively efficiently in spite of many daunting challenges during the licensing process. A total of nearly the twenties (20) dairy-related products were successfully announced over the years. As a result, obtaining the required licenses facilitated the Client to keep its business operation and product distribution much smoother and more convenient.
